Pathey provides informational estimates generated from market data, formulas, and artificial intelligence. It is not a financial adviser, broker, exchange, sportsbook, fiduciary, or guarantor. Information may be incomplete, delayed, inaccurate, or wrong. You can lose some or all money you choose to invest, trade, or wager.
Agreement and eligibility
These Terms of Service (“Terms”) form a binding agreement between you and the operator of Pathey (“Pathey,” “we,” “us,” or “our”) and govern your access to the Pathey mobile application, website, AI coach, route information, and related services (collectively, the “Services”).
By downloading, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You may use Pathey only if you are at least 18 years old, can legally enter a binding contract, and are not barred from using the Services under applicable law. Pathey is not directed to minors. You may not use any market, investment, prediction-market, gambling, or wagering feature unless doing so is lawful for you and in your location.
What Pathey provides—and does not provide
Pathey is a publishing and informational comparison tool. Based on inputs such as a starting amount, target, timeframe, and risk preference, it may display “routes” across categories such as savings, treasuries, stocks, crypto assets, prediction markets, and sports lines. Pathey may estimate probability, potential return, risk, capital requirements, time to payout, or a combined value score.
Pathey does not open or manage financial accounts, receive deposits, hold or custody funds or assets, execute securities or crypto transactions, place bets or wagers, accept stakes, clear or settle transactions, guarantee liquidity, or control any third-party account. If you choose to act, you do so separately through a third party and at your sole discretion and risk.
Route rankings, labels such as “safe,” “strong,” or “best,” and AI coach explanations describe Pathey’s model outputs only. They are not certifications, promises, endorsements, or instructions to transact.
Not financial, investment, betting, tax, or legal advice
Pathey and its content are provided solely for general informational and entertainment purposes. Nothing in the Services is personalized financial planning, investment advice, a securities recommendation, gambling advice, tax advice, legal advice, an offer or solicitation, or a substitute for advice from a qualified professional who understands your full circumstances.
Pathey is not registered as an investment adviser, broker-dealer, securities exchange, commodity trading adviser, financial planner, bank, money transmitter, sportsbook, gaming operator, or fiduciary. No advisory, brokerage, fiduciary, agency, trustee, partnership, or similar relationship is created by your use of the Services.
Your inputs do not give Pathey a complete picture of your finances, debts, taxes, income, emergency needs, risk capacity, legal restrictions, or personal circumstances. Consult appropriately licensed financial, tax, legal, and other professionals before making decisions. Independently confirm registration and licensing of any professional or platform you use.
Market risk, AI limitations, and no guarantees
You may lose money
All investing, trading, crypto, prediction-market, and wagering activity involves risk. Higher potential returns generally involve higher risk. Some positions can lose the entire amount committed, may be illiquid, may not settle as expected, or may be affected by platform failure, regulatory action, market manipulation, taxes, fees, or counterparty risk.
Estimates are not outcomes
Probabilities, scores, expected returns, prices, yields, timing estimates, and rankings are estimates, not guarantees. Past performance, historical data, backtests, implied probabilities, consensus estimates, and hypothetical examples do not predict future results. A route can rank first and still lose.
AI can be wrong
AI-generated content may be inaccurate, incomplete, fabricated, inconsistent, outdated, or based on flawed inputs. It may misunderstand a market, contract, rule, deadline, source, or question. Do not rely solely on Pathey or its AI coach. Verify material facts, current prices, terms, market resolution criteria, fees, legality, and risks directly with primary sources and qualified professionals before acting.
Information changes quickly
Quotes and public data may be delayed, stale, unavailable, incorrectly matched, or different from executable prices. Alerts and notifications may be delayed or never delivered. Do not rely on Pathey to monitor a position, prevent a loss, meet a deadline, or tell you when to buy, sell, close, hedge, or withdraw.
Third-party data, platforms, and links
Pathey uses or references third-party market data, public sources, AI services, platforms, websites, and content. We do not control and are not responsible for their accuracy, availability, security, legality, fees, rules, privacy practices, solvency, licensing, market resolution, trade execution, settlement, or conduct.
A link, platform name, ticker, contract, route, price, or ranking does not imply sponsorship, partnership, verification, or endorsement. Your use of any third party is governed by its own terms and privacy policy. Disputes about a transaction, wager, account, withdrawal, settlement, or third-party service are between you and that third party.
Third-party trademarks belong to their owners and are used for identification and comparison only.
Your responsibilities
You are solely responsible for every decision and action you take, including whether a route is suitable and lawful, how much money you expose, and whether you can afford a loss. You agree to:
- Perform independent research and verify important information through primary sources.
- Review executable prices, fees, taxes, eligibility, contract terms, resolution criteria, and withdrawal restrictions before acting.
- Use only properly licensed or lawful platforms available in your jurisdiction.
- Comply with securities, commodities, gaming, gambling, sanctions, tax, and consumer laws that apply to you.
- Never risk money needed for housing, food, medical care, taxes, debt obligations, or emergencies.
- Maintain your own records and seek professional advice when appropriate.
- Not treat a Pathey notification, score, route, or AI response as an instruction or guarantee.
Accounts, security, and purchases
You must provide accurate account information, keep credentials and devices secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of applicable law.
You may delete your account through Profile → Delete account. Deletion is permanent and does not unwind transactions or delete third-party accounts.
Pathey does not currently process live subscription billing. If paid features are introduced, the price, renewal period, trial terms, and cancellation method will be disclosed before purchase. Purchases made through Apple are also subject to Apple’s payment and subscription terms. Deleting your Pathey account may not cancel an Apple subscription; you must manage Apple subscriptions through your Apple account. Except where required by law or an app-store policy, fees are non-refundable.
License, ownership, and acceptable use
Subject to these Terms, Pathey grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for lawful, non-commercial purposes. Pathey and its licensors retain all rights in the Services, including software, design, branding, scoring methods, compilation, text, and other content.
You may not misuse the Services, including by attempting unauthorized access; scraping or extracting data at scale; reverse engineering except where law expressly permits it; bypassing limits or security; using automated systems without permission; introducing malware; impersonating others; infringing rights; manipulating markets; facilitating fraud, money laundering, illegal wagering, or other unlawful conduct; or using Pathey outputs to create a competing product without written permission.
If you submit feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you without permission.
Warranty disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. PATHEY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, SECURITY, AVAILABILITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, error-free, secure, or suitable for you; that data or AI output will be accurate; that any route will be available or profitable; that alerts will arrive; or that defects will be corrected. No oral or written information creates a warranty not expressly stated in these Terms.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
Limitation of liability and indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHEY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, SAVINGS, OPPORTUNITY, DATA, OR GOODWILL; TRADING, INVESTMENT, WAGERING, TAX, OR BUSINESS LOSSES; OR DAMAGES ARISING FROM AI OUTPUT, MARKET DATA, THIRD-PARTY PLATFORMS, UNAUTHORIZED ACCESS, SERVICE INTERRUPTION, OR RELIANCE ON THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PATHEY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PATHEY FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, willful misconduct, or personal injury where applicable law prohibits exclusion.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pathey and the parties listed above from claims, losses, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful or unauthorized use, your breach of these Terms, your violation of another person’s rights, or transactions and wagers you independently choose to make. This obligation does not apply to the extent a claim is caused by Pathey’s own violation of law.
Service changes, suspension, and termination
We may add, modify, suspend, or discontinue features, data sources, routes, pricing, or the Services. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in abuse or fraud, or if required by law or a provider.
You may stop using Pathey at any time and may delete your account. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnity, dispute terms, and general provisions—survive termination.
Disputes, Apple terms, and general provisions
Informal resolution
Before filing a claim, you and Pathey agree to make a good-faith effort to resolve it informally for at least 30 days. Send a written description of the issue and requested relief to [email protected]. This requirement does not prevent either party from seeking urgent injunctive relief or using small-claims procedures where available.
Applicable law and mandatory rights
These Terms are governed by applicable law and do not override mandatory consumer protections available where you live. Any claim must be brought in a court with lawful jurisdiction over the parties and dispute, unless the parties separately agree to another lawful process.
Apple
For the iOS app, these Terms supplement Apple’s Standard Licensed Application End User License Agreement. Apple is not responsible for Pathey, its content, support, maintenance, warranties, claims, or third-party rights. To the extent required by Apple’s terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
General
If a provision is unenforceable, it will be enforced to the maximum permitted extent and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale. These Terms, the Privacy Policy, and applicable purchase terms are the entire agreement concerning the Services.
We may update these Terms. Material changes will be posted or otherwise communicated as required by law. Continued use after the effective date means you accept the revised Terms.
